The confidentiality of your personal data is one of the main concerns ofMyStreet Technology ( hereinafter referred to as MyStreet ), MyStreet constantly monitors and ensures that the processing of personal data strictly complies with the principles and legislation on the protection of personal data.

This privacy policy covers the personal data of MyStreet Customers and other Users of the www.mystreet.com or the MyStreet application, through which personal data are collected, including the Couriers, the representatives of the Partners, as these persons have been defined herein.

 

  • Definitions

 

MyStreet means a computer program (software), which also includes its graphical interface, on which MyStreet owns all copyrights, respectively the computer program designed to be run on a mobile computer device, such as smartphone and / or tablet, and / or on a computer and which is made available to Users by MyStreet, including, in accordance with MyStreet business policies, through the websitewww.mystreet.com ( www.mystreet.com or Website ).

Client means the natural or legal person who purchases one or more Products, by placing a firm order with the Courier, using MyStreet.

Personal data means any information concerning an identified or identifiable natural person (data subject); an identifiable person is a person who can be identified, directly or indirectly, in particular by reference to an identification element, such as a name, an identification number, location data, an online identifier, or one or more specific elements of his physical, physiological, genetic, mental, economic, cultural or social identity.

Courier – means both the MyStreet Courier and the Third Party Courier.

Partner – means MyStreet partners whose products can be purchased through MyStreet, including potential Partners who contact MyStreet to become a partner store.

Processing“ (and its derivatives, including without limitation the processing) means any operation or set of operations performed on Personal Data, including without limitation the collection, registration, storage, modification, use, disclosure, access, transfer or destruction thereof.

User" - anyone who accesses or uses MyStreet.

Other capitalized terms that have not been defined in this Privacy Policy will have the meaning assigned to them according to the definitions in the MyStreet Terms and Conditions. – more details here.

 

  • Categories of Personal Data processed

 

III.1.If you are a Customer, MyStreet will process the following Personal Data:

(i) name and surname, telephone number, domicile / residence address, delivery address, e-mail address, signature, geolocation data (provided by the IT equipment on which MyStreet is installed / running, if the geolocation function is activated on that Computer Equipment), the chosen payment method, Ordered Basket Products, as well as any other data that the Customer provides directly through MyStreet and / or through the Courier, on the occasion of the delivery of the Ordered Products or through the use of the Service (eg User Provided Content as defined in the Terms and Conditions).

(ii) if the registration of the User account in MyStreet is done through the Facebook or Google account, MyStreet will process the following public profile data displayed by the respective applications: username, e-mail address;

(ii) MyStreet can also process data about how MyStreet is used, such as behavior / preferences / habits within MyStreet, previous commands made through MyStreet;

(iii) other data provided directly, such as through messages in the forms completed on the Site. 

III.2. If you are a User, MyStreet will process the following Personal Data:

  1. name and surname, telephone, e-mail address;

 

  1. if the registration of the User account in MyStreet is done through the Facebook or Google account, MyStreet will process the following public profile data displayed by the respective applications: username, e-mail address;

 

  1. MyStreet may also process data on how MyStreet is used such as behavior / preferences / habits within MyStreet, previous commands made through MyStreet;

(v) other data provided directly, such as through messages in the forms completed on the Site.

III.3. If you are the contact person of the Partners / Suppliers of legal entities or potential Partners / Suppliers of legal entities, MyStreet will process the following Personal Data:

(i) name and surname, e-mail address and telephone number that you provide in the context of initiating or developing the contractual relationship with MyStreet, including through the form available on MyStreet;

(ii) name, surname, position in the context of feedback on collaboration with MyStreet that are published on the Site;

(iii) other data provided directly, such as through messages in the forms completed on the Site.

III.4. If you are a potential Courier (individual or similar), MyStreet will process the following Personal Data:

(i) name, surname, e-mail address, telephone number, city, information regarding the possession of a driving license, a car provided through the application available on the Site;

(ii) other data provided directly, such as through messages in the forms completed on the Site.

  • Purposes and grounds of processing

 

IV.1. If you are a User or Client:

(i) for concluding and developing the contractual relationship between the User / Client and MyStreet, defined in the Terms and Conditions, such as, but not limited to: account creation, account authentication, submission of forms through the MyStreet Site or application, contacting MyStreet in any way with regarding the use of MyStreet, taking over, validating, sending and invoicing the Customer's order, informing the Customer on the status of the order and delivery to the Customer of the ordered Products, informing the Customer on any options for ordering the Products in the area, receiving and using coupons as part of promotional campaigns in case a User leaves a negative review on MyStreet, he may be contacted, including by telephone, by MyStreet, Couriers or other contractual partners of MyStreet in order to resolve the complaint / request and to improve the Services offered through MyStreet .

Basis: conclusion and execution of a contract (represented by acceptance of the Terms and Conditions)

(ii) for fulfillment of legal obligations incumbent on MyStreet in the context of the services provided through MyStreet, including financial, accounting, tax and archiving obligations, the settlement of claims in the field of exercising the rights of data subjects with regard to the processing of personal data.

Basis: MyStreet's legal obligations

(iii) for direct marketing activities - data on first and last name, e-mail address, telephone, postal address can be collected and processed for marketing, advertising, publicity. to this end, the data will be processed for transmission by means of distance communication, such as e-mail, telephone, including via the MyStreet application and push * notifications, promotional offers and any other news, on the products and services offered through MyStreet; 

*Note: A push notification is a message that appears on a mobile device, which can be  transmitted at any time, without the need for users to be in the application or use their devices to receive such messages.

When you have given your consent for such processing / subscribed to the newsletter, you have the right to withdraw your consent or to object, at any time. Withdrawal of consent will not affect the legality of processing performed by MyStreet prior to the withdrawal of the agreement. Also, unsubscribing can be done by accessing the links indicated in this regard in the text of commercial messages received by e-mail, respectively through the options available in your account.

Basis: User / Customer Consent

(iv) for fulfilling the legitimate interests of MyStreet, for the purpose of carrying out various analyzes, reporting on the operation of the Services, creating consumer preference profiles, resolving other requests, notifications other than those mentioned in points (i) and (ii) above, mainly in order to improve Services provided by MyStreet. MyStreet will also be able to transmit statistical data to its Partners. However, we note that all information thus transmitted to third parties will be provided in aggregate form, without including data that could lead to the identification (directly or indirectly) of the data subjects. 

Basis: MyStreet's legitimate interest in ensuring the optimal operation and promotion of MyStreet or in defending its rights and interests in the event of potential lawsuits or other litigation.

Basis of processing: consent, performance of the contract or legitimate interest.

  1. 2 If you are a contact person for Partners / Suppliers Third party legal entities or potential Partners / Suppliers Third party legal entities:

(i) for the purpose of processing the form submitted through the Site, in order to initiate or develop the contractual relationship with the Partners / Third Party Suppliers legal entities.

Basis: The contract (represented by the acceptance of the Terms and Conditions of use of the Site) in case of the completed form on the Site.

(ii) for fulfilling the legitimate interests of MyStreet, in order to initiate or carry out the contractual relationship with the Partners / Third Party Suppliers legal entities for the other situations, except for the situation of filling in the forms on the Site, reflected above in point (i), respectively for analysis, publishing feedback on the Site, performing other analyzes , reports, statistics, including on how to use the Site.

Basis: MyStreet's legitimate interest in initiating or developing a contractual relationship with Partners / Third Party Suppliers legal entities

(iii) for fulfillment of legal obligations incumbent on MyStreet in the context of the services provided through MyStreet, including financial, accounting, tax and archiving obligations, the settlement of claims in the field of exercising the rights of data subjects with regard to the processing of personal data.

IV.3. If you are a potential Courier

(i) in orderinitiation, development of the contractual relationship with MyStreet, by using the form / application on the Site or by contacting MyStreet in another way.

Basis: The contract (represented by the acceptance of the Terms and Conditions of use of the Site, respectively in order to conclude a collaboration / employment contract, as the case may be).

(ii) for fulfilling the legitimate interests of MyStreet, in order to initiate or carry out the contractual relationship with the Partners for the other situations, except for the situation of filling in the forms on the Site, reflected above in point (i), respectively for analysis, publication of feedback on the Site, other analyzes, reports, statistics, including how to use the Suppliers section of the Site.

Basis: MyStreet's legitimate interest in initiating or carrying out the contractual relationship with the Couriers.

(iii) for fulfillment of legal obligations incumbent on MyStreet in the context of the services provided through MyStreet, including financial, accounting, tax and archiving obligations, the settlement of claims in the field of exercising the rights of data subjects with regard to the processing of personal data.

  • Duration of processing Personal Data

 

V.1. Retention periods, respectively the criteria used to establish them

In principle, MyStreet will process Personal Data for the entire duration of the contractual relationship, and subsequently personal data will be stored for periods applicable to various types of Personal Data, established according to the MyStreet policy for storage and archiving of data and documents, respectively on the time required to fulfill the legal obligations incumbent on MyStreet (for example, in the case of financial-accounting supporting documents for which the retention period provided by law is 10 years from the end of the financial year in which they were prepared).

If you withdraw your consent to the processing of data and there are no other Legal Basis for processing (for example, the existence of a legal obligation, the existence of a contractual relationship, the legitimate interest of MyStreet) or you object to the processing and there are no legitimate and compelling reasons for processing prevail, MyStreet will stop processing your Personal Data. 

regarding the data of the potential Couriers, these will be kept depending on the relationship that will be established between them and MyStreet, thus:

(i) potential Suppliers with whom employment contracts are concluded will be kept in the personnel file, for the period established by the internal procedures regarding the storage and archiving of data and documents; 

(ii) potential Third Party Suppliers (natural or similar persons) with whom collaboration / service contracts are concluded, see section IX de mai jos.

(iii) potential Couriers who have not been selected for a working or collaborative relationship with MyStreet, the data will be kept for a period of 3 years. Users' data regarding their navigation on MyStreet, such as those resulting from the monitoring of consumer preferences, order history, geolocation data (including addresses / coordinates of delivery addresses indicated by the Customer) will be processed by the time the person concerned requests the deletion of this data, in accordance with the law. Subsequently, MyStreet may order the anonymization of this data, thus depriving it of personal character and continue to process anonymous data for statistical purposes.

Certain data regarding the fulfillment of the legal obligations incumbent on MyStreet (eg, information on the processing of personal data) or data on requests / complaints related to the processing of data, may be kept for a period of 4 years or more when there is a legitimate interest.

V.2. if the User / Customer wants to close / delete the account

in case the User / Client, as the case may be, wishes to close / delete the account, it will not be deleted automatically nor does it have the automatic effect of deleting his Personal Data from the account by pressing the button “Delete account . To prevent the User / Client from accidentally pressing the account deletion button, MyStreet will display a User / Customer pop-up message asking the latter to confirm that they wish to delete the account. 

if the User / Customer confirms that he wishes to delete the account, MyStreet will consider that, reasonably, such a request implies by default(i) data deletion and(ii) withdrawal of User / Customer consent for data processing for direct marketing purposes. 

within a maximum of one month from the date of registration of the request, MyStreet will communicate to the User / Client the manner of solving the request, except in cases where the legal response period is extended according to law. 

When a Customer requests the account to be closed / deleted, but there is at least one active order on that account, the account deletion request can only be registered after the delivery of the Products and the completion of the last active order. Also, certain categories of Personal Data may be further processed by MyStreet in view of the applicable legal obligations, respectively our legitimate interests (such as, defense of rights or interests, management of any requests).

 

  • Persons who may have access to Personal Data

 

Personal Data is mainly processed by MyStreet, through its employees or collaborators authorized to process personal data.

Personal data may also be disclosed to the following categories of persons:

(i) Couriers, regarding Customer data to enable them to provide Delivery Services to Customers and, in certain situations, to be able to verify, respond to and resolve Customer complaints, as appropriate;

(ii) MyStreet proxies who may process the data in the name and on behalf of MyStreet for any of the above purposes;

(iii) To the public authorities, in response to a request for information made in compliance with legal provisions or in any case for MyStreet to fulfill a legal obligation thereof;

(iv) Third parties, in connection with or during negotiations for a merger, sale of MyStreet assets, consolidation or restructuring, financing or acquisition of MyStreet or any portion thereof by other entities;

(v) MyStreet Partners or other third parties with whom MyStreet enters into contractual relationships for various purposes such as: in the case of promotional campaigns organized by MyStreet together with those contractual partners or its affiliates, maintaining, personalizing and improving MyStreet and the services provided through it, for performing data analysis, testing and research, monitoring trends in use and activity, developing security features and authentication of Users, as well as for the transmission of advertising / promotional materials, under the conditions and limits provided by law;

(vi) To the general public, in the case of User-Provided Content, as defined and detailed in Section X of the MyStreet Terms and Conditions.

Partners or Third Party Providers process your data on their own behalf, as data controllers, and MyStreet has no control over how your data is processed by these Partners or Third Party Providers. Therefore, for the activities of processing your Personal Data carried out by MyStreet Partners or Third Party Providers, and with which you enter into relations through MyStreet, please consult and take into account the privacy policies and other policies of interest offered. of them.

 

  • Transfer of Personal Data

 

The Personal Data provided to MyStreet can be transferred outside Romania, to states in the European Economic Area.

 

  • Providing Personal Data

 

The provision of Personal Data may be a contractual obligation or an obligation necessary for the conclusion of a contract, and is necessary in order to benefit from the products and services provided through MyStreet. Refusal to provide Personal Data may result in the impossibility of benefiting from the products and services provided to you through MyStreet, respectively the impossibility of developing contractual relations with MyStreet, and Couriers will not be able to use MyStreet to provide Delivery Services. For direct marketing activities, such as subscribing to the newsletter, providing your data is voluntary. 

Although MyStreet requires consent to the processing of certain Personal Data, such agreement may not always be required by law. Thus, MyStreet may use, for example, other Legal Basis for data processing, such as the execution of the contract concluded with the User, compliance with the legal obligations of MyStreet, or the legitimate interest in data processing for analysis, reporting on how operation of the Services, the creation of consumer preference profiles, mainly in order to improve the Services offered by MyStreet.

 

  • Processing of Personal Data of Third Party Suppliers

 

If you are a Third Party Courier (individual or similar) you will find in this section information on how we process your data in the context of using the MyStreet application.

IX.1. Data categories: MyStreet will process the following Personal Data of Third Party Providers in the context of using MyStreet: name and surname, telephone, e-mail address, image, means of transport used, geolocation data, and any other data provided by it via MyStreet, such as User-Provided Content (as defined in the Terms and Conditions).

IX.2. Purpose and Basis of processing: The Personal Data of Third Party Couriers are processed for the purpose of conducting contractual relations with MyStreet, including for the purpose of executing orders placed by the Customer within MyStreet, in the Basis of the contractual relationship, established by accepting the Terms and Conditions of use of MyStreet. Also, the data of potential Third Party Couriers requesting to become Couriers through the contact form available on the Site are processed to make necessary and prior steps to conclude a contract.

IX.3. Data recipients: Certain Personal Data will be disclosed to Customers in order to carry out the contract that they conclude with the Third Party Courier through MyStreet, for the purpose of carrying out the Delivery Services. Certain Personal Data may also be disclosed to MyStreet proxies, public authorities of any kind, organizations, service and goods providers, as well as to other recipients mentioned above in letters(ii) – (vi) of Section VI. Also, certain Personal Data (such as name, surname, image, geolocation data) can be viewed in MyStreet and by other Providers registered in MyStreet.

IX.4. Duration of processing Personal Data:

In principle, MyStreet will process Personal Data for the entire duration of the contractual relationship, and subsequently personal data will be stored for periods applicable to various types of Personal Data, established according to the MyStreet policy for storage and archiving of data and documents, respectively on the time required to fulfill the legal obligations incumbent on MyStreet (for example, in the case of financial-accounting supporting documents for which the retention period provided by law is 10 years from the end of the financial year in which they were drawn up).

The geo-location data, when the geo-location services are activated in the MyStreet application used by the Third Party Courier, will be processed for the purpose and for the period necessary to determine the delivery address of the Products and to calculate the roadmaps. For this purpose, the geolocation data can be kept for up to 3 months. 

MyStreet will delete the account of the Third Party Provider from MyStreet after the termination of the collaboration (the service contract concluded by it) with MyStreet.

IX.5. Transfer of Personal Data 

The Personal Data provided to MyStreet can be transferred outside Romania, to states in the European Economic Area.

IX.6. Providing Personal Data

Providing the data to Third Party Couriers are necessary to perform the steps prior to the conclusion of the contract, respectively in order to execute the contract. Refusal to provide Personal Data may result in the impossibility of conducting contractual relations with MyStreet, including the impossibility of using MyStreet in order to provide Delivery Services. 

 

  • Rights of the data subject

 

According to the applicable legal provisions, regarding the processing of Personal Data indicated in this Policy, you have the right to request access to your personal data, rectification, deletion or restriction of processing, the right to oppose the processing within the limits and conditions provided by law, the right not to be subject to an automatic decision, if it produces legal effects or similarly affects you, to a significant extent (eg, automatic refusal to enter into a contract with you, based on automatic processing data), as well as the right to data portability.

Also, if you choose to give your consent, you have the right to withdraw it at any time. Also, at any time, the User has access to his identification / contact data, being able to edit / modify them, directly in MyStreet, in the My Account Section. To unsubscribe from commercial communications, the User may use the option at the end of each email containing commercial communications. To disable geolocation services, the User can access the settings of the IT Device used at any time.
